These terms are an agreement between you and Fullspec Studio LLC, 6234 W Spray Lake Dr, West Jordan, Utah 84081, “we” below. They cover the ImgCrisp WordPress plugin, the ImgCrisp image service at api.imgcrisp.com, credits, and this website. By installing the plugin, connecting it to the service or buying credits, you agree to them. If you use ImgCrisp for a client or a business, you agree on its behalf and confirm you are allowed to.

The plugin

The plugin is free software, released under the GNU General Public License, version 2 or later, and listed on WordPress.org. The GPL gives you the right to use, study, change and share the plugin’s code. Nothing in these terms takes those rights away. Every feature is in the free plugin; nothing is locked behind payment.

The service

The plugin sends images to our service to make them smaller and, when you ask, to upscale them. The service is what credits pay for.

• What it does: it returns lighter copies of each image (a recompressed original plus WebP and AVIF, for each WordPress size). When you confirm an upscale, it returns a larger, sharper copy made by a super-resolution AI model trained on photographs, which a specialist upscaling provider runs for us.
• Your originals stay safe: every original is backed up on your site, and you can restore any image, one at a time, whenever you like.
• No guarantee of a particular saving. Some images cannot get smaller without a visible change. When that happens, the original is kept and you are not charged.
• Availability. We work to keep the service running, but we do not promise it will never be down, slow or interrupted. If it is unavailable, your site keeps serving the images it already has.
• Changes. We may improve or change the service. If a change removes something you rely on or changes what you pay, we will tell you in advance.

Your account and API key

[Accounts are not live yet. As planned:] You need an account and an API key to use the service. Keep your key secret: anything done with it counts as done by you. If you think someone else has your key, replace it from your account, or write to us and we will help.

Credits and payment

Credits pay for the service’s work. Prices are shown on the pricing page and are provisional until billing launches.

• What costs a credit. An optimization costs 30 credits and covers one image with all its sizes and formats. An AI upscale costs 210 credits, which includes optimizing the upscaled image, and the plugin shows you the cost and asks you to confirm before anything is spent.
• What is free. An optimization that makes nothing smaller, a job that fails, a status check, restoring an original, and anything already done: the same image is never charged twice.
• Free trial. New accounts get 50 free image optimizations, with no card needed. The trial starts when you verify your account and connect your first site, lasts 30 days, and is shared across your sites. An optimization that makes nothing smaller, or that fails, does not use up the trial. Each account and each site can have one trial. The trial does not include upscales.
• Subscriptions renew each month until you cancel. Unused monthly credits carry over up to twice the monthly allowance, and stay usable for 90 days after a subscription ends.
• One-off packs never expire.
• Credits are shared across all your sites. They have no cash value and cannot be transferred to another account.
• Payments are taken by Stripe. Prices are in US dollars and exclude any taxes we are required to add.
• No automatic purchases. We never buy credits for you. Automatic optimization of new uploads stays off until you switch it on in the plugin’s settings.

Refunds

You can ask for a refund of unused purchased credits within 14 days of buying them. If you have used some, we refund the unused part. For a subscription, this applies to the most recent payment. Ask through the contact form. These terms do not limit any refund rights you have under the law where you live.

If a payment is disputed or reversed, we may freeze the unspent credits from that payment until the dispute is settled.

Fair use

Please do not:

• upload images you have no right to process;
• upload unlawful content, including content that sexually exploits children, which we will report;
• try to break, overload, reverse engineer or get around the limits of the service;
• share your API key, resell the service, or use it to build a competing service;
• create several accounts or sites to use free trials more than once.

We may suspend or close an account that breaks these rules. If we do, we will tell you why, unless the law stops us. We will refund any unspent purchased credits, unless the account was closed for fraud or abuse.

Your images

Your images remain yours. You give us permission to process them only to provide the service to you. We do not keep them, publish them, or use them to train anything. The privacy page explains exactly what the service receives and who else processes it.

You are responsible for having the rights to the images you process, including the right to have them upscaled.

AI upscaling

An upscale adds detail that was not in the original image. The result is an estimate, not a recovery of the original scene, and it may contain artifacts. Check an upscaled image before you rely on it, especially for faces, text or anything where accuracy matters. Enlargements over 3× are warned about before you confirm.

Disclaimer

Except as these terms state, the plugin and the service are provided “as is”, without warranties of any kind, to the fullest extent the law allows. Keep your own backups of your site, as you would with any plugin.

Limit of liability

To the fullest extent the law allows, we are not liable for indirect or consequential losses, such as lost profits, lost data or lost business. Our total liability for any claim about ImgCrisp is limited to the amount you paid us in the 12 months before the claim, or US$50 if you have paid nothing. Nothing in these terms limits liability that cannot be limited by law.

Ending

You can stop using ImgCrisp at any time: deactivate the plugin, cancel any subscription, and restore your originals if you like. We may end these terms if you break them, as described under Fair use. Sections about your images, the disclaimer, liability and the governing law keep applying after the terms end.

Changes to these terms

We may update these terms. We will change the date at the top, and for a change that matters we will give you at least 30 days’ notice, in the plugin’s changelog and by email if you have an account. If you keep using ImgCrisp after a change takes effect, the new terms apply.

Governing law

These terms are governed by the laws of the State of Utah, United States, without regard to its conflict-of-law rules. Disputes go to the state and federal courts located in Salt Lake County, Utah, except where the law where you live gives you the right to bring a claim at home.
